This Short-Term Rental Agreement is made by and between WILMA Properties, LLC ("Homeowner") and the Guest as of the date this booking is submitted. Guest must be the primary occupant throughout the rental period and may not serve solely as the booking agent for another party.
The parties agree to the following:
PROPERTY: The property is located at 354 Larkspur Loop, Crested Butte, CO
CHECK-IN AND CHECK-OUT: The Rental begins at 4pm on date stated on reservation. Check-out time is 10:00am the final day of reservation.
RESERVATION REQUIREMENTS and PAYMENT: 50% of the rental is required in advance to hold reservation. Balance of total rental is due 45 days prior to arrival and will be automatically charged when a credit card has been supplied or receive a check for final payment by the date 45 days prior to arrival date. Homeowner does not accept checks on reservations made less than 60 days before arrival. Credit Card PAYMENT IS DONE THROUGH THE On- Line payment process. Acceptable payment methods are credit card or check. Check must be received within 10 days after booking inquiry.
CANCELLATION POLICY: If Guest wishes to cancel their reservation, they will be refunded as follows:
- 60 days before check-in, 100% refund.
- Less than 60 days, no refund.
OCCUPANCY REGULATIONS: PLEASE READ CAREFULLY! The maximum number of guests is limited to 8 (eight). All rentals units are subject to occupancy limits. (Occupancy includes everyone over the age of 1). These limits are established either by state fire code regulations, town rules, and/or Homeowner Association Rules. Guest agrees to abide by that limit and pay any fines issued by an Association. Guest further agrees that the Homeowner has the right to terminate this Agreement before the end of the rental period if the limit is exceeded and any such termination will result in a forfeiture of al monies paid on the reservation.
RENTAL PARTY: You must be 25 years of age to reserve. Someone 25 years of age or older must also be in residence during entire rental period. A reservation obtained under false pretense will be subject to eviction and forfeiture of all amounts prepaid. Guest must provide photo proof of identification (driver's license or passport) for verification of age and address. Name and address on ID must match the name and address of the person signing the Rental Agreement and paying via a credit card.
CONFIRMATION: Confirmation of the reservation will be sent upon receipt of the reservation advance payment through the VRBO booking system.
CHARGES TO CREDIT CARD POSSIBLE AFTER DEPARTURE: Additional charges may be due to any of the following:
- Damage or breakage to the property or furnishings that are not covered by or exceed the insurance policy
- Dirt or other mess requiring excessive cleaning
- Any other cost incurred by Homeowner due to Guest’s stay ( retrieving and shipping costs of left articles or personal belongings, replacement of lost keys…)
- Any missing property or furnishings • Evidence of pet and additional cleaning needed due to pet, or damage caused by pet
- Exceeding the limit of occupancy
SMOKING & PETS: Smoking or vaping of any kind of products are NOT allowed. Pets are NOT permitted.
HOMEOWNERS ASSOCIATION RULES: The guest and persons accompanying the guest agree to abide the rules of the Homeowners Association.
OWNER AND AGENT: Are not responsible for loss, theft or personal injuries sustained by the guest or person accompanying guest.
MAINTENANCE: Guest shall allow Homeowner and /or Homeowner’s agent access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner and attempt to notify Guest in advance. It is possible that it might be necessary to temporarily close or provide maintenance to tennis courts, basketball goals, lakes, hot tub, and /or common elements in the community during your stay. Additionally, the homeowner does not guarantee against mechanical failure of heating, televisions, DVD players, SONOS system, plumbing, refrigeration or other appliance or utilities such as Internet, Cable/ Phone service or construction work in the community. The renter agrees to report any inoperative equipment, disruption in service or disturbances to the Homeowner and/or House manager. No discounts or refunds will be given for equipment/appliance/utility/plumbing failure or maintenance noise or disruption that occurs during your stay.
Every effort is made to keep our home clean and well maintained. Please notify me or the House manager upon arrival if the home is unsatisfactory for any reason so we have the opportunity to address it. Please do not wait until departing to voice a complaint…we want to be immediately aware of any concerns or problems so we can rectify the situation.
PARKING RESTRICTIONS: parking is provided for 2 vehicles in the private driveway. Parking on the street is not allowed overnight and is subject to neighborhood ordinances. Storing trailers in the neighborhood streets is NOT allowed. Our private garage is NOT allowed for parking.
QUIET TIME: Noise travels easily in the community. Please be respectful and observe a 9:00pm to 8:00am quiet time. Noise violations may result in immediate eviction and forfeiture of all monies prepaid.
LOST ITEMS: Left items that are found can be returned upon request, with a fee for retrieval, processing, and shipping. Unclaimed items will be disposed of 30 days after a guest’s departure date.
FURNISHED IN UNIT: Basic kitchen supplies, bedding, bath towels, and hair dryers are provided. More personal items such as soaps, shampoo, laundry detergent are not provided. Basic spices and a starter supply of paper products are supplied, however guests are responsible for additional items needed during your stay. We are happy to share our Crested Butte home with you and trust you will respect it as your own. Guests shall take good care of premises and agrees not to move or alter any of the furnishings and to be responsible for all conditions caused by negligence, wrongful acts or omissions of the persons accompanying guest.
DEFAULTS: If the guest defaults in the performance of any obligations contained herein, and a suit at law is brought against the guest and /or persons accompanying the guest, the Homeowner shall be entitled to recover all costs and expenses including court costs and attorney fees.
INDEMNIFICATION AND HOLD HARMLESS: Guest agrees to indemnify and hold harmless OWNER and their representatives from and against any liability for personal injury or property damage sustained by any person (including Guest’s Guests) as a result of any cause occurring on the premises or any part, or in common areas.
RENTAL RATES AND FEES: Rates are subject to change without notice until the reservation is confirmed.
DEPOSIT: A deposit of 50% of the Rental Fee is required in advance to hold your reservation and is due at the time of booking. Balance of total rental is due 45 days prior to arrival and will be automatically charged when a credit card has been supplied. The deposit is applied toward the rental fees, and is non-refundable except as specified in our Cancellation Policy of this Agreement.
We do not accept checks on reservations made less than 60 days before arrival.
TRAVEL INSURANCE: “Damage Protection Insurance” active for the duration of the booking is required to book a stay
CLEANING FEE: $450.00
